What is Wage Theft?

Wage theft happens when employers don’t pay workers the full amount they’ve earned, breaking labor laws. This practice is illegal, and employees affected by wage theft have the right to pursue claims to recover unpaid wages and hold employers accountable. We can provide legal support to help ensure you are treated fairly under wage and hour laws.

Wage theft can occur in several ways, including:

Underpayment: Paying employees below the minimum wage.
Overtime Violations: Not compensating for overtime hours or using incorrect overtime rates.
Misclassification: Classifying employees as independent contractors to avoid paying benefits and overtime.
Unauthorized Deductions: Making improper deductions from an employee's paycheck.
Meal and Rest Break Violations: Failing to provide or compensate for mandatory meal and rest breaks.
Off-the-Clock Work: Requiring employees to work without pay outside their scheduled hours. (donning and doffing)
Pay Stub Violations: Not providing accurate and detailed wage statements with each paycheck.
Final Paycheck Violations: Delaying or withholding final wages after employment ends.
Tipped Employee Violations: Taking tips from employees or not ensuring their total compensation meets the minimum wage when tips are insufficient.

Wage Theft or Loss of Wages

Each year, workers in California lose an estimated $2 billion to wage theft. Despite the state's strong employee protection laws, wage theft remains a widespread issue, particularly affecting low-wage and hourly workers. Many employees are unaware that they are being shortchanged by their employers, and those who do know are often hesitant to act out of fear of retaliation.

In 2021, California workers sought only $320 million in civil restitution for unpaid wages—a small portion of the $2 billion estimated to be stolen annually.

To address this issue, the state recently enacted a law aimed at taking a tougher stance against employers who intentionally withhold wages.
